The Colorado Division of Insurance (DOI) has adopted a new regulation that changes how homeowners request certified copies of their insurance policies. Regulation 5-1-27 outlines specific procedures for these requests. You can read the full notice of adoption here.
Previously, policyholders could request certified copies directly from their insurance agent or claims adjuster. This often allowed for quicker, more straightforward communication with familiar insurance company contacts.
Now, under Regulation 5-1-27, requests must go through a formal process:
- Policyholders or their representatives must submit a written request to the insurance carrier’s registered agent.
- The registered agent is typically a corporate address designated for official service of process.
- Once the request reaches the registered agent, the insurer must deliver the certified copy to the policyholder within 30 days.
The underlying statute, § 10-4-110.8(10), C.R.S., requires insurers to provide non-certified copies within three business days of any request, and within 30 days of any certified copy request. However, the new Regulation 5-1-27’s procedural rules focus solely on the process for obtaining certified copies and do not address non-certified copy requests. Under the statute, the insurance company must comply with requests for electronic or paper delivery.
How to Find and Contact an Insurer’s Registered Agent
To locate an insurer’s registered agent, visit the DOI’s service of process page here. You will need to download the list and locate the contact details for the insurer’s registered agent.
Recommended Steps for Requesting a Certified Copy
- Identify the insurer’s registered agent using the DOI list.
- Draft a clear written request, including your policy number, full name, and electronic or paper delivery preferences.
- Send it via certified mail to ensure proof of receipt.
- Track the 30-day timeline and follow up if needed.
These changes aim to standardize the process but may slow down and complicate access for homeowners working through claims or coverage disputes.
